Introduction

Welcome to Easy Sunday, where we offer a unique blend of luxury coffee experiences. These Terms of Service (“Terms”) govern your use of our website and services. By accessing our site, you agree to these Terms in full. We provide specialty coffee products and related services, subject to the following conditions. Please read these Terms carefully before using our services.

Acceptance of Terms

By using Easy Sunday’s services, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must not use our services. These Terms apply to all visitors, users, and others who access or use the Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

Registration and Account Security

To access certain features of our service, you may be required to register an account. When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. Easy Sunday cannot and will not be liable for any loss or damage arising from your failure to comply with these security obligations.

Payment Terms

We accept a variety of payment methods through Stripe and PayPal, including credit cards, debit cards, and electronic payments. All transactions are processed securely and your payment information is handled with the utmost confidentiality. Payment must be made at the time of purchase and you agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us.

Shipping and Delivery

We offer free shipping on all orders within the United States. Our coffee is freshly roasted and shipped on the same day to ensure peak freshness. Please allow up to 3 days for delivery. During promotions or giveaways, please anticipate a delay of 2-5 days due to increased volume. We are not responsible for any shipping deliveries that may be affected by customs, natural occurrences, transfers from our shipping carrier to the local carrier in your country, or air and ground transportation strikes or delays.

Membership Cancellation and Renewal

Members may cancel their subscription at any time by contacting customer service. However, please note that cancellation will result in the forfeiture of any future membership benefits. Memberships can be renewed at any time to continue enjoying member-exclusive perks. If you wish to cancel your subscription, you must do so before your next billing cycle to avoid being charged for the next period. Upon cancellation, you will still have access to the subscription benefits until the end of your current billing cycle.

Eligibility for Complimentary Stays

To qualify for a complimentary hotel stay, members must have been subscribed to Easy Sunday for a minimum of 3 months. This benefit is designed to reward our loyal members and provide them with an opportunity to enjoy a luxurious getaway. Eligibility is automatically assessed, and qualifying members will be notified via their preferred method of communication, either email or SMS.

Age Requirement For Stays

All members wishing to utilize a complimentary hotel stay must be at least 21 years old. This age requirement ensures that all guests can fully enjoy the amenities offered by our partner hotels and comply with any legal age restrictions that may be in place at the destination.

Booking and Travel Policy

Complimentary hotel stays are intended for personal use and relaxation; therefore, group travel is strictly prohibited. If a member is found to be abusing this policy by organizing group travel, their membership will be subject to immediate revocation and a permanent ban from future membership. We encourage members to use these stays as a chance for individual or dual relaxation and exploration.

Destination Restrictions

When booking a complimentary stay, members must choose a destination that is at least 100 miles away from their city of residence. This policy is in place to encourage exploration and ensure that members experience a true getaway. Complimentary hotel stays are not available for use in the member’s own city to maintain the exclusivity and special nature of the benefit.

Availability and Limitations

Currently, complimentary hotel stays are available exclusively to US residents. Easy Sunday does not cover additional travel accommodations such as flights, dining, or other expenses. Our goal is to provide a memorable stay at a luxury hotel, and we encourage members to plan their travel accordingly.

Hotel Stay Details

The complimentary stays are designed to accommodate two people, making them perfect for a couple’s retreat or a special outing with a friend. Should members wish to include additional guests, they may be subject to an additional fee as per the hotel’s policy. Members are also responsible for any hotel resort fees, which vary by location and must be settled directly with the hotel.

Non-Affiliation with Travel Agencies

Easy Sunday is not a travel agency and is not affiliated with any travel agencies. The complimentary hotel stays are a member benefit offered through partnerships with select hotels. We provide this benefit to enhance the value of your membership and offer you an exclusive experience.

Dispute Resolution

If you have any concerns or disputes about the Service, you agree to first try to resolve the dispute informally by contacting Easy Sunday. We will attempt to resolve any disputes with you quickly and efficiently. If you and Easy Sunday are unable to resolve the dispute informally, we each agree to resolve any claim, dispute, or controversy through binding arbitration or small claims court, instead of in courts of general jurisdiction. Arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA’s Supplementary Procedures for Consumer-Related Disputes.

Warranty and Disclaimer

Easy Sunday provides specialty coffee and related products with a commitment to the highest standards of quality. We warrant that the products will be of satisfactory quality and fit for their general purpose. However, this warranty does not apply to any defect in the product arising from fair wear and tear, willful damage, accident, negligence by you or any third party, or use otherwise than as recommended by us. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations. Any warranty claims must be made within thirty (30) days of product delivery.

User-Generated Content

Users may post content such as reviews, comments, photos, and other materials. You are solely responsible for the user-generated content that you submit, post, or display on or through the Service. By posting content, you grant Easy Sunday a non-exclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; and that use of the content you supply does not violate these Terms and will not cause injury to any person or entity.

Promotions and Offers

From time to time, Easy Sunday may offer promotions and special offers to users. These promotions may be subject to additional terms and conditions that will be made available at the time of the promotion. Promotions are only valid for the time period specified and may not be combined with other offers. We reserve the right to cancel or modify promotions at any time without prior notice. Participation in promotions is voluntary and you are not obligated to participate in any promotion.

User Responsibilities

You agree to use our services only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of Easy Sunday. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within our services. You must not use our website to send unsolicited commercial communications. You must not use the content on our website for any marketing-related purpose without our express written consent.

Intellectual Property

The Service and its original content (excluding User-Generated Content), features, and functionality are and will remain the exclusive property of Easy Sunday and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Easy Sunday.

Limitation of Liability

In no event shall Easy Sunday, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

No Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Easy Sunday’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
